Perion Network Ltd. (collectively with its affiliates and subsidiaries shall be referred to as “Perion”, “we”, “us” or “our”) provides advertising and monetization solutions across various channels, to drive unmatched brand lift and audience engagement, to both Advertisers and Publishers.
The term “Publishers” refers to those involved in selling ad space on various digital assets, including without limitations, mobile apps, smart TV apps, channels, players, websites, social media pages and even digital out of home (“DOOH”) assets such as electronic billboards, placed in public areas. The term “Advertiser” refers to brands, networks, and other providers such as SSPs, DSPs, exchange platforms, etc. Perion connects the Publisher assets with the Advertiser solutions to enable the Publishers to monetize their assets (collectively, all of Perion’s advertising solutions shall be referred herein as the “Offering”).
The Offering include, among others, display ad units, video ad units (pre-roll, mid-roll and post-roll ads), interactive components, instream ad units, AI-based dynamic audio ads, social advertising, CTV ad units, ad network enabling participation in real time auction bidding, media buying and brand promotion, insights and analytics on the applicable campaign, and many more monetization and advertising solutions.
Further, the Offering are managed through an online platform, in which the Publisher or Advertiser, as applicable, can log in through a web-based app (“Platform”) and manage the Offering, review insights and reporting regarding the applicable campaign, review the payment information, reports and other information related to the Offering (the platform, account and Offering shall collectively be referred herein as the “Services”).
This privacy policy (“Privacy Policy” or “Policy”) describes how Perion, collects, uses and discloses certain information, including Personal Data (as defined hereunder) about individuals who access Perion’s website available at: https://www.perion.com/, Perion’s social media pages and its sales and marketing activities, Platform, all as detailed hereunder.
This Privacy Policy constitutes an integral part of our website’s Terms of Use (collectively the “Terms”), and provides you with information regarding what Personal Data we collect and for what purposes, our data processing operations, the lawful basis pursuant to which we process your Personal Data, third parties to whom Personal Data will be transferred, data retention principles, etc. This Privacy Policy also describes how you may exercise your rights, where and to the extent applicable under relevant privacy legislation, including the EU General Data Protection Regulation (“GDPR”) and the California Consumer Privacy Act (“CCPA”) (together “Privacy Legislation”).

Definitions used herein but not defined herein shall have the meaning ascribed to them in the Terms or the relevant Privacy Legislation.
You are not required by law to provide us with any Personal Data. Sharing your Personal Data with us is entirely voluntary. However, without your data, we would not always be able to provide you with all or some of our Services.
POLICY AMENDMENTS
We reserve the right to amend this Policy from time to time, at our sole discretion. The most recent version of the Policy will always be posted on the website. The updated date of the Policy will be reflected in the “Last Modified” heading. We will provide notice if these changes are material and, where required by applicable law, we will obtain your consent. Any amendments to the Policy will become effective within 30-days upon the display of the modified Policy. Perion Network Ltd. incorporated under the laws of the state of Israel, is the Data Controller (as such term is defined under the GDPR or equivalent Privacy Legislation) of the Personal Data as set forth in this privacy policy and specifically in Section 2 below. You do not have a legal duty to provide the information, and providing it, is subject to your willing consent. However, there are areas of the Website that require the use of Personal Information to complete their customization functions, and such may not be available to those choosing not to reveal the information requested.

“Non-Personal Data”
During your interaction with our website, we may collect aggregated, non-personal non-identifiable information which may be made available or gathered via your access to and use of our website (“Non- Personal Data”). We are not aware of the identity of the user from which the Non-Personal Data is collected. The Non-Personal Data which is being collected may include your aggregated usage information and technical information transmitted by your device such as: type of browser, internet service provider (ISP), operating system and version, mobile network information, device settings (e.g. default language), etc.

We may also collect from you, during your access or interaction with our website, individually identifiable information, namely information that identifies an individual or may with reasonable effort be used to identify an individual (“Personal Data” or “Personal Information”).
For avoidance of doubt, any Non-Personal Data connected or linked to any Personal Data shall be deemed as Personal Data as long as such connection or linkage exists.
We do not knowingly collect or process any Personal Data constituting or revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data, data concerning a person’s health or data concerning a person’s sex life or sexual orientation (“Special Categories of Personal Data”).

Online Identifiers and Usage Data
When you access our website and Platform, we may collect certain online identifiers such as IP address, unique identifiers, access logs, etc. (“Online Identifiers”).
We further collect usage data that includes your click stream data, which sites your visited, which pages you viewed on our website, when you accessed and used the Platform, if there where any errors or crashes, etc. (all “Usage Data”).
We process such data for operational and technical purposes, such as to enable the website and Platform, to detect fraud and errors, ensuring the Services are secured.
Maintaining the website, marketing and analytics:
We use Usage Data from the website for our marketing purpose and for identifying potential partners and prospects. When we collect Usage Data from the Platform, the purpose is to customize the Service, optimize your experience, support and security purposes
First party cookies are strictly necessary and are used to enable the operation of the website.
We process the Online Identifiers and Usage Data through third party cookies based on legitimate interest or consent which is provided through the cookie notice and consent manager. You may withdraw consent at any time by using the cookie preference settings available at the bottom on the page.

When you visit a website and before we collect the Online Identifiers, Usage Data, etc. for analytic and marketing purposes as described hereinabove, you will be presented with a cookie banner which is part of our cookie manager platform (“CMP”). In the event you sign up to receive our newsletter or other marketing or informational materials, you will be requested to provide your contact details, such as your name and email address.
We process such data in order to provide you with the content that you have requested to receive.
We process such data based on your consent. You may
withdraw consent at any time through the “ unsubscribe” link within the email or by
contacting us directly. We maintain the Personal Data as part of our opt-out list
(solely the necessary Personal Data for such purpose) under
our legitimate interest and to ensure we comply with such

Account Information (Publishers/Advertisers)
When you use our Platform (UDrive, Launchpad, Publisher UI), you will create an account or be designated with an account, from which you may use such interfaces and review the reports. The account information includes your Contact Information, billing information, access logs and usage data (such as the time and date the account was accessed for the duration, as detailed above).
Account information is processed solely to provide our Services, reports and insights.

Please note that, the actual processing operation per each purpose of use and lawful basis detailed in the table above, may differ. Such processing operation usually includes a set of operations, made by automated means, such as collection, storage, use, disclosure by transmission, erasure or destruction. Transfer of Personal Data to third party countries as further detailed in the International Data Transfer section is based on the same lawful basis as stipulated in the table above.
In addition, we may use certain Personal Data to prevent potentially prohibited or illegal activities, fraud, misappropriation, infringements, identity thefts and any other misuse of the website and to enforce our policies and agreements, as well as to protect the security or integrity of our databases and the website, and to take precautions against legal liability. Such processing is based on our legitimate interests.
Depending on the nature of your interaction with us, we may collect information either automatically or voluntarily provided by you.

We work hard to protect Personal Data we process from unauthorized access or unauthorized alteration, disclosure or destruction. We have implemented physical, technical and administrative security measures for the website that comply with applicable laws and industry such as: encryption using SSL, we minimize the amount of data that we store on our servers, restrict access to Personal Data to Perion employees, contractors and agents, etc. Note that, we cannot be held responsible for unauthorized or unintended access that is beyond our control, and we make no warranty, express, implied or otherwise, that we will always be able to prevent such access.
Our data servers in which we host and store the information are located in the US. Perion’s HQ are based in Israel in which we may access the information stored on such servers or other systems such as Perion’s ERP, CRM and other systems. In the event that we need to transfer your Personal Data out of your jurisdiction, we will take appropriate measures to ensure that your Personal Data receives an adequate level of protection as required under applicable law. Furthermore, when Personal Data that is collected within the European Economic Area (“EEA“) is transferred outside of the EEA to a country that has not received an adequacy decision from the European Commission, we will take necessary steps in order to ensure that sufficient safeguards are provided during the transferring of such Personal Data, in accordance with the provision of the standard contractual clauses approved by the European Union. Thus, we will obtain contractual commitments and or assurances from the data importer to protect your Personal Data, using contractual protections that EEA and UK regulators have pre-approved to ensure your data is protected (known as standard contract clauses), or rely on adequacy decisions issued by the European Commission. Some of these assurances are well recognized certification schemes.
